COURT OF APPEAL HANDS A 16 YEAR JAIL TERM TO A MAN OVER RAPE

A bitter rapist has been jailed 16 years in prison for turning his anger on a 20-year-old woman who rejected his love advances.

The Court of Appeal panel comprising justices Cheborion Barishaki, Hellen Obura and Eva Luswata, handed the sentence to Joseph Kimbowa after finding him guilty of rape.   

The court heard evidence that Kimbowa usually passed by the woman’s house as he made his sinister moves before pouncing on the victim.

According to the justices, the prosecution adduced evidence indicating that Kimbowa on December 23, 2017, at Nabaziza cell, Kyengera Town Council in Wakiso District performed a sexual act with a woman, without her consent.

The court heard that Kimbowa had one time proposed to have a love affair with the victim but she refused.

On December 23, 2017, at about 9:00 am, the victim was at home with her brother when Kimbowa asked her to sell him some cabbages and the victim proceeded to cut cabbages in the garden and when handing them to the latter, he held her by the mouth, pulled her into the bush and raped her.

Court documents show that the victim raised an alarm which alerted her father Joseph Sentamu, who arrived at the scene and found the appellant still on top of her.

Sentamu also raised an alarm and with the help of other people, removed the appellant from the victim, arrested him and took him to Kyengera Police, where the victim recorded a statement and trial followed later.
